1. Agreement and who operates Mythspan

These Terms of Use govern access to and use of the Mythspan website, community, campaign library, submission tools, accounts, comments, ratings, saved stories, communications, and related services, together called the "Services".

Mythspan is currently an unincorporated project operated directly by its founders. In these Terms, "Mythspan", "we", "us", and "our" mean that project and the persons operating it. "Founders" means the founders and operators of Mythspan from time to time. "Affiliates" means the Founders and any present or future person, company, partnership, project, brand, successor, assignee, or other entity that controls, is controlled by, is under common control with, owns, operates, supports, succeeds to, or is formed to own or operate Mythspan or any related service. "Protected Parties" means Mythspan, the Founders, Affiliates, moderators, contractors, service providers, licensors, successors, and assigns.

By accessing or using the Services, creating an account, posting a comment, rating a story, or submitting content, you agree to these Terms and acknowledge the Privacy Policy. If you do not agree, do not use the Services.

2. What Mythspan provides

Mythspan is a free community and inspiration service for original D&D and Tabletop RPG campaign ideas, stories, discussion, and related creative material. The Services may include material written by Mythspan, the Founders, community members, and third parties.

Mythspan does not promise that any story, rule interpretation, historical reference, comment, rating, recommendation, or other material is accurate, complete, original, safe, suitable, or fit for a particular game, group, audience, or purpose. You decide what to use and how to use it.

3. Eligibility and accounts

You must be at least 18 years old and legally capable of agreeing to these Terms. You must provide accurate account information, keep it current, protect your login methods and devices, and notify us promptly if you believe your account has been compromised.

You are responsible for activity carried out through your account. You may not sell, transfer, share, or allow another person to use your account in a way that misrepresents identity or avoids a restriction.

4. Limited permission to use the Services

Subject to these Terms, Mythspan grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable permission to access and use the Services for lawful personal and community participation. This permission does not transfer ownership of any part of the Services or any Mythspan intellectual property.

You may use campaign material at your own private tabletop games. You may not republish, sell, license, scrape, train a model on, systematically extract, create a competing database from, or commercially exploit the Services or any substantial part of them without our prior written permission.

5. Acceptable use

You must not use the Services to break the law, infringe another person's rights, harass or threaten anyone, impersonate another person, publish private or confidential information, distribute malware, evade access controls, manipulate ratings or engagement, scrape the Services, create accounts in bulk, or interfere with security or operation.

You must not submit content that is unlawful, defamatory, plagiarised, fraudulent, sexually exploitative, abusive, hateful, or designed to facilitate harm. Fiction may include difficult themes, but content warnings do not excuse unlawful material or targeted abuse. The Community Guidelines form part of these Terms.

6. Submission and community content

"User Content" means anything you submit, upload, post, send, or otherwise make available through or to Mythspan, including campaign ideas, premises, plots, settings, characters, encounters, twists, titles, text, images, comments, ratings, profile information, messages, suggestions, and feedback. A "Submission" is User Content sent for possible publication in the campaign library or another Mythspan channel.

You retain any ownership rights you already hold in your User Content. When you provide User Content, you grant Mythspan and its Affiliates a perpetual, irrevocable, worldwide, royalty-free, fully paid-up, transferable, sublicensable, non-exclusive licence to host, store, reproduce, publish, display, perform, distribute, communicate, transmit, translate, edit, format, abridge, expand, combine, adapt, modify, create derivative works from, promote, market, commercialise, license, sell, and otherwise use or exploit that User Content, in whole or in part, in any media or technology now known or later developed, for any purpose connected with Mythspan, its Affiliates, or any related or successor project, product, service, publication, promotion, or business.

This licence includes the right to use the concepts, ideas, systems, structures, themes, titles, and other elements contained in User Content to the extent any rights exist in them. It continues forever, survives account deletion, content removal, and termination of these Terms, and cannot be withdrawn. No payment, royalty, accounting, approval, further consent, or notice is owed to you unless Mythspan separately agrees in writing.

To the maximum extent permitted by law, you waive and agree not to assert moral rights and similar rights in relation to uses allowed by this licence. Where a waiver is not permitted, you consent to editing, adaptation, non-attribution, different attribution, combination with other material, and other acts that would otherwise require consent. Mythspan may credit your chosen name or handle, but has no obligation to publish, retain, promote, or attribute User Content.

User Content is not confidential. Do not send trade secrets, confidential material, or ideas you expect Mythspan to hold in confidence. Mythspan and others may already be developing, may later develop, or may receive material that is similar or identical. You agree that similarity alone does not create a duty, claim, compensation right, or restriction on Mythspan, the Founders, or Affiliates.

You represent and warrant that you created the User Content or have every right, permission, and consent needed to provide it and grant this licence; that it does not infringe intellectual property, privacy, publicity, confidentiality, contractual, or other rights; that it is not unlawful or misleading; and that any person shown or identified has given the necessary consent.

7. Feedback and ideas about Mythspan

If you provide ideas, suggestions, improvements, feature requests, designs, names, methods, or other feedback about Mythspan or a related product or service, you assign to Mythspan and the Founders all right, title, and interest in that feedback, including future intellectual property rights. If an assignment is not legally effective, you grant the same perpetual, irrevocable, worldwide, royalty-free, fully paid-up, transferable, sublicensable, exclusive licence described above. Mythspan may use that feedback without restriction, attribution, or compensation.

8. Mythspan intellectual property

The Services and all material created, commissioned, acquired, curated, or published by Mythspan or the Founders, including the Mythspan name and marks, original campaign ideas, story concepts, narrative structures, editorial presentation, artwork, text, software, interfaces, graphics, taxonomies, collections, selection, arrangement, methods, features, and designs, are owned by Mythspan, the Founders, Affiliates, or their licensors and are protected by intellectual property and other laws.

Except for the limited permission expressly given in these Terms, all rights are reserved. You may not use Mythspan branding, remove rights notices, claim Mythspan material as your own, or use the Services or their content to create, train, market, or improve a competing product or content library without prior written permission.

9. Moderation, publication, and removal

Mythspan may review, edit, refuse, publish, unpublish, restrict, preserve, or remove User Content and may warn, restrict, suspend, or terminate accounts at any time. We are not required to monitor all content and do not endorse User Content by allowing it to appear.

If you believe content infringes your rights or creates a safety concern, email mythspan@gmail.com with enough detail for us to identify and assess it. We may request evidence of identity, ownership, authority, or context.

10. Other users, games, and off-platform activity

You are responsible for your dealings with other users and for any campaign, game, event, server, chat, meeting, or transaction arranged through or after using the Services. Mythspan does not screen every user, supervise games, verify identities or qualifications, or control conduct outside the Services. Use your own judgement and take appropriate safety precautions.

11. Third-party services and links

The Services may link to or rely on third-party authentication, hosting, analytics, email, social, community, or other services. Their terms and privacy practices may apply. The Protected Parties do not control and are not responsible for third-party services, content, availability, security, or conduct.

12. A free and changing service

The Services are currently provided without charge. Mythspan may add, remove, suspend, limit, or change any feature, content, eligibility requirement, availability, or part of the Services at any time. Mythspan may introduce paid features later under additional terms. No user has a right to continued access, publication, storage, ranking, traffic, credit, or availability.

13. Disclaimers

To the maximum extent permitted by law, the Services and all content are provided "as is" and "as available", entirely at your own risk. The Protected Parties make no warranty, representation, condition, or guarantee, express, implied, statutory, or otherwise, concerning accuracy, originality, non-infringement, merchantability, satisfactory quality, fitness for a particular purpose, availability, security, moderation, compatibility, or results.

The Protected Parties do not promise that the Services will be uninterrupted, error-free, secure, current, recoverable, or free from harmful components, or that defects, disputes, plagiarism, misconduct, data loss, or unauthorised access will be found or corrected. You are responsible for evaluating content, keeping your own copies, and deciding whether any material is appropriate for your players and circumstances.

14. Exclusion and limitation of liability

To the maximum extent permitted by law, the Protected Parties will not be liable for any claim, loss, damage, cost, expense, liability, or remedy arising out of or connected with the Services, these Terms, any content, any user, any game, any submission, any third-party service, or your reliance on or inability to use any of them, whether the claim arises in contract, tort, negligence, statute, equity, misrepresentation, restitution, or otherwise.

This exclusion includes direct, indirect, incidental, special, consequential, exemplary, and punitive loss and any loss of data, content, profits, revenue, business, opportunity, goodwill, reputation, anticipated savings, privacy, use, or enjoyment, even if a Protected Party knew or should have known that the loss was possible.

If liability cannot lawfully be excluded, the total aggregate liability of all Protected Parties combined for all claims arising out of or connected with the Services or these Terms will not exceed the greater of the amount you paid directly to Mythspan for the Services during the 12 months before the event giving rise to the claim and SGD 10.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited. Every disclaimer, exclusion, and limitation applies only to the maximum extent permitted by applicable law.

15. Release

To the maximum extent permitted by law, you release the Protected Parties from claims and disputes arising from User Content, another user, an off-platform interaction, a game or event, a submission decision, or any third-party service. This release does not apply to a claim that applicable law does not permit you to release.

16. Indemnity

To the maximum extent permitted by law, you will indemnify and hold harmless the Protected Parties from claims, proceedings, losses, liabilities, damages, settlements, penalties, costs, and expenses, including reasonable legal fees, arising out of or connected with your User Content, your conduct, your breach of these Terms, your infringement or violation of another person's rights, your unlawful activity, or your fraud, wilful misconduct, or negligence. Mythspan may control the defence and settlement of an indemnified matter, and you agree to cooperate.

17. Suspension and termination

You may stop using the Services at any time. Mythspan may restrict, suspend, or terminate access, remove content, or discontinue the Services at any time where reasonably considered necessary for legal, safety, operational, reputational, or community reasons, or without cause where permitted by law.

Terms that should continue by their nature survive termination, including provisions on licences, ownership, feedback, disclaimers, liability, release, indemnity, disputes, and general terms.

18. Privacy

The Privacy Policy explains how Mythspan may collect, use, disclose, retain, and protect personal information. Public posts and profile information may be seen, copied, discussed, or shared by others.

19. Governing law and disputes

These Terms are governed by the laws of Singapore, except to the extent mandatory laws of your country of residence apply. You submit to the non-exclusive jurisdiction of the courts of Singapore for disputes arising out of or connected with these Terms or the Services, subject to any mandatory right to bring a claim elsewhere.

Before commencing formal proceedings, you agree to email mythspan@gmail.com and make a genuine attempt to resolve the dispute informally, unless applicable law permits you to proceed without doing so.

20. General terms

Mythspan may assign or transfer these Terms and any rights or obligations under them to an Affiliate, successor, or future entity formed to own or operate Mythspan. You may not assign them without prior written consent. If any provision is unlawful or unenforceable, it will be enforced to the greatest lawful extent and the remaining provisions will continue. A delay in enforcing a right is not a waiver. These Terms, the Privacy Policy, and documents expressly incorporated into them form the entire agreement about the Services.

21. Changes and contact

Mythspan may update these Terms. The updated version takes effect from the stated date. Where a change materially affects existing users, we may provide notice through the Services or by email. Continued use after the effective date constitutes acceptance to the extent permitted by law.
